This Returns Policy outlines your rights and responsibilities under the Consumer Protection Act (CPA) of South Africa. Please read this policy carefully to understand how returns, exchanges, and refunds are handled.
1. General Return Rights
In accordance with the Consumer Protection Act of South Africa, you are entitled to return goods under certain conditions, as outlined below:
- Cooling-Off Period: If you purchase a product through direct marketing, you have a right to cancel the purchase without penalty and return the product within 5 (five) business days of receiving the goods. In such cases, you will be refunded the full purchase price, excluding any delivery costs and a 10% handling fee, subject to the approval of our suppliers.
- Returns for Defective Goods: You have the right to return goods that are defective, unsafe, or of poor quality within 6 (six) months of purchase. You may choose to have the goods repaired, replaced, or receive a full refund. This right applies only if the defect was not caused by misuse or abuse of the goods. In the case of non-defective returns, a 10% handling fee will be deducted from your refund. However, all refunds and exchanges are subject to the decision of our suppliers, and ELT Creations cannot guarantee a refund or exchange without their approval.
- Non-Returnable Items: No refunds, returns, or exchanges will be accepted for custom-ordered items or items that have been customized, personalized, or altered as per user specifications. These items are considered final sale and are not eligible for return under any circumstances.
- Items Sold "As Is": All items are sold "as is" and "voetstoots" unless otherwise specified in the advertisement for the item. This means that items are sold in their current condition, and no warranties or guarantees apply unless explicitly stated otherwise.
2. Conditions for Returns
To ensure your return is accepted, the following conditions must be met:
- Proof of Purchase: You must provide proof of purchase (e.g., a receipt or order confirmation).
- Original Packaging: The item must be returned in its original packaging with all accessories and documentation included.
- Condition of Goods: Goods must be unused, undamaged, and in their original condition, unless you are returning defective goods.
3. Process for Returning Goods
If you wish to return an item, follow these steps:
1. Contact Us: Email us at [email protected] with your order number, a description of the reason for return, and whether you prefer a repair, replacement, or refund.
2. Prepare the Goods: Ensure the goods are securely packaged to avoid damage during transit.
3. Return Shipping: The cost of shipping for all returns, including defective goods and exchanges, will be for the purchaser’s account. If the goods are defective, we will facilitate the return, but the cost of shipping remains your responsibility.
4. Handling Fee: A 10% handling fee will be deducted from all refunds on returned goods. This fee applies to non-defective returns and covers administrative and processing costs.
5. Supplier Approval: All returns, refunds, or exchanges are subject to the approval of our suppliers. ELT Creations acts as a reseller of items, and therefore the final decision regarding any refunds or exchanges rests solely with our suppliers.
6. Inspection and Resolution: Upon receiving your returned goods, we will inspect them to confirm the reason for the return. Once we receive confirmation from our supplier, we will process your request for a repair, replacement, or refund within 10 (ten) business days.
4. Refunds
- No Refunds During Lead Time: No refunds will be made during the lead time once the product has been ordered from the supplier. This means that once an order is placed with the supplier, the order cannot be canceled, and refunds will not be issued.
- Method of Refund: Refunds will be issued in the original form of payment (e.g., credit card, EFT) unless otherwise agreed.
- Timeframe for Refunds: Refunds will be processed within 10 (ten) business days after we receive and inspect the returned goods, subject to supplier approval.
- Deductions: A 10% handling fee will be deducted from the refund amount for non-defective returns.
- Partial Refunds: If the goods returned show signs of use, wear, or damage that is not due to a defect, we may issue a partial refund at our discretion, subject to supplier approval.
5. Exchanges
- Exchanging Goods: If you wish to exchange an item for a different size, color, or product, please follow the same steps outlined in the "Process for Returning Goods" section. Exchanges will be subject to stock availability and supplier approval.
- Timeframe for Exchanges: Once we receive your returned item, we will process the exchange within 10 (ten) business days, pending supplier approval. If the requested item is unavailable, we will offer a refund or alternative product, subject to the supplier’s decision.
- Shipping Costs for Exchanges: All shipping costs for exchanges will be at the purchaser’s expense.
6. Warranty Repairs
If goods become defective after the 6 (six) month return period but are still under warranty, we will facilitate repairs as per the manufacturer's warranty terms. Any additional repair costs and shipping fees will be for the purchaser’s account, subject to supplier approval.
